Section 816.103 (a) Continued. <br />• pesure by erosion, formation of acid or toxic seeps, to provide an <br />adequate depth for plant growth, or otherwis=_ to meet local conditions, <br />the regulatory authority shall specify thicker amounts of cover using <br />non-toxic material, or special compaction and isolation from ground <br />water contact. <br />(4) Acid-forming or toxic-forming materials shall not be buried or <br />stored in proximity to a drainage course so as to cause or pose a threat <br />of water pollution. <br />Energy Fuels will not have any exposed coal seams remaining at the <br />end of mining and reclamation. <br />For discussion on acid- and toxic-forming materials refer to <br />Sections 779.14 (b)(1)(iv) and 780.18 (b)(7). <br />• (b) Stabilization. Backfilled materials shall be selectively hauled or <br />conveyed, and compacted, wherever necessary to prevent leaching of acid- <br />forming and toxic-forming materials into surface or ground waters and <br />wherever necessary to insure stability of the backfilled materials. The <br />method and design specifications of cemoacting materials shall be <br />approved by the regulatory authorit}- before acid-forming or toxic- <br />forming materials are covered. <br />Backfilling will be performed by the normal day-to-day operation <br />of the draglines as they side-cast spoil into the previous pit. <br />Dozers will remove the spoil ridges and graders and scrapers will <br />re-shape to approximate the original contours. This equipment <br />will also provide compaction. A specific description for this <br />process together with related maps is set forth under Section <br />780.18. <br /> Generally, an exhaustive analysis of 190 overburden samples indi- <br />• cafes that no toxicity problems are present.
