Section 816.105 (b) Continued. <br />• and suitable waste materials; and <br />(6) Meet the revegetation requirements of Sections 816.111-816.117 for all <br />disturbed areas. <br />Energy Fuels will not be mining in any area which comes under the <br />definition of thick overburden as discussed in Section 816.105 (a). <br />However, as demonstrated in Section 780.35, the most suitable <br />postmining contour and elevations are achieved by backfilling the final <br />pit with previous spoil ridges and leaving boxcut material in <br />permanent excess spoil piles as designed in Sections 816.72-816.73. <br />Section 816.106 Regrading or stabilizing rills and gullies. <br />41hen rills or gullies deeper than 9 inches form in areas that have been <br />regraded and topsoiled, the rills and gullies shall be filled, graded, or <br />• otherwise stabilized and the area reseeded or replanted according to <br />Sections 816.111-816.117. The regulatory authority shall specify that rills <br />or gullies of lesser size be stabilized and the area reseeded or replanted <br />if the rills or gullies are disruptive to the approved post-raining land use <br />or may result in additional erosion and sedimentation. <br />Implementation of the soil stabilization practices outlined under <br />Section 816.114 will minimize potential erosion hazards. The detention <br />capacity of the contour furrows are designed to prevent overland flow. <br />Studies in the northern Great Plains, as reported by Dollhopf, et <br />al. (1977) using similar surface manipulation techniques dramatically <br />demonstrate the detention capacity of contour furrows. <br />Techniques used for the repair and stabilization of gullies requiring <br />remedial measures include the use of barriers, check dams, erosion <br />stops, matting and roughened surfaces. In some cases, existing rills <br />and gullies will be monitored and not immediately repaired.
