<br />.~~ and mineable leased cool therefrom es reasonably posslbla. <br />• ~ ` <br /> • Lessee agrees to use deep mining methods to eztreet tha <br /> mineable and merchantable coal whenever and wherever auch <br /> method is necessary end approprie to and Lessee understands <br /> that its agreement to employ such deep mining methods is a <br /> materinl inducement for Lessor to enter into this Lease. <br />i <br />• ~ Lessee shall comply in every respect with the mining and <br /> j environmental laws and regulations of the State of Colorado, <br /> ~ ~ the United States, and local laws now existing or hereafter <br /> passed, regulating the management and operation of coal <br />' ~ mines. ' <br /> For the purpose of this Lease, 'mineable and <br /> i <br /> merchantable coal' shall mean coal which, when reached in <br /> the prosecution of Lessee's operations hereunder, can be <br /> I mined and sold at a profit on the market then prevailing, by <br />i <br /> the use of machinery, mining methods and management which <br /> are acceptable in the mining industry. <br />• ~ Shovld any unmineable or unmerchantable coal be <br />( abandoned by the Lessee through the conduct of its operations <br /> hereunder in such manner that such coal may not thereafter <br /> • be practically mineable by the Lessee, or should the Lessee <br /> at any time declare by written notice to Lessor that it does <br /> not intend to mine any such unmineable or unmerchantable <br /> coal, then Lessor shall promptly execute an instrument of <br /> release acceptable to Lessor covering the coal and coal <br /> rights which it wishes to abandon and the lands in which <br /> such coal is located and thereafter Lessor may lease such <br /> abandoned coal to others; provided, however, that no lease <br /> to another lessee or lessees shall permit unreaso nable~ <br /> interference with the mining operations of the Lessee he=sunder; <br /> and provided further, [het such other mining operations <br />(Rev. 5/86) <br />
