All rights <br />. ,~ <br />' and remedies given hereunder shall be cumulative end not ' <br />exclusive. <br />ARTICLE 22 - Default by Lessee <br />This Lease is made by the Lessor and accepted by <br />the Lessee upon the express condition that, if the Lessee <br />shall fail or refuse to pay the royalties, including minimum ' <br />royalties, when due, and any such default or failure shall <br />continue for a period of fifteen (15) days after written <br />notice thereof is. given to Lessee by Lessor, then this Lease <br />~.~ ~ ~ shell, at the option of the Lessor, terminate and be void. <br />If the Lessee shell fail to keep and perform any of the <br />. other covenants and agreements herein contained to be per- <br />j formed by it and Lessee shall not have cured or commenced to <br />' ~ cure such default and continue such curative action with <br />~ diligence, within thirty (30) days after written notice <br />r <br />• thereof given to the Lessee by the Lessor, then this Lease <br />shall, at the option of the Lessoi, terminate and be void. <br />i Opon the occurrence of any ~of tie foregoing defaults, the <br />) to lure of Lessee to cure such default, and the election of <br />the Lessor to declare this Lease terminated and void, the <br />Lessor may re-enter, expel the Lessee and those holding, <br />under it, and hold the leased coal and the Property as its <br />absolute property, as though this Lease had never been <br />executed.
