1) The services of a consultant were contracted to identify the <br />• source of the problem causing the alleged exceedances; 2) <br />Preliminary results of the consultant's study indicated that a <br />treatment system my be required and this system would require <br />routing of the underground mine's discharge through old pit prior <br />to entering Pond D; 3) A minor revision was submitted to the <br />Colorado Mined Land Reclamation Division by Twentymile Coal <br />Company (underground mine operator) to allow routing of the <br />underground mine's discharge through the old pit. Based upon <br />review of the data collected recently, it appears that system is <br />not required and the minor revision request was withdrawn. <br />Final Resolution of Alleged Violation: A civil penalty of $1,260 <br />per violation was set and this civil penalty was paid on October <br />6, 1986 <br />Alleged Violation Identification: Notice of Violation C-86-021, <br />Permit 84-062 <br />Date of Issuance: March 20, 1986 <br />Issuing Regulatory Authority: <br />Colorado Mined Land Reclamation Division <br />Brief Description of Alleged Violation: <br />Failure to follow approved hydrologic monitoring plan <br />• Date, Location and Type of Administrative Proceedings: <br />April 30, 1986 - Denver, Colorado, Notice of Violation Assessment <br />Conference <br />Current Status: Terminated, May 27, 1986 <br />Actions taken to Abate the Alleged Violation: <br />Monitoring program requirements were reviewed with staff so that <br />all required data is collected. <br />Final Resolution of Alleged Violation: <br />Colorado Yampa Coal Company paid assessment penalty of $1,400 to <br />the Colorado Mined Land Reclamation Division <br />Alleged Violation Identification: Notice of Violation C-86-023, <br />Permit No. C-81-071 <br />Date of Issuance: March 20, 1986 <br />Issuing Regulatory Authority: <br />Colorado Mined Land Reclamation Division <br />Brief Description of Alleged Violation: Failure to follow <br />approved hydrologic monitoring plan <br />Date, Location and Type of Administrative Proceedings: <br />• April 30, 1986 - Denver, Colorado Notice of Violation Assessment <br />Conference <br />-20- Revised 12/22/86 <br />
