Current Status: A "Stipulated Agreement between the Water <br />• Quality Control Division of the Colorado Department of Health and <br />The Colorado Yampa Coal Company" has been signed (September 2, <br />1986) resulting in a settlement of the NOV and Cease and Desist <br />Order. The number of violations were reduced from ten to two. <br />Actions Taken to Abate the Alleged Violation: <br />The following actions were taken to abate the violations: <br />1) Pond D was cleaned out to reduce the accumulation of sediment <br />in the pond; 2) The Colorado Department of Health was informed <br />on June 12, 1985 of Colorado Yampa Coal Company's intention to <br />petition the Water Commission for a change in effluent <br />limitations; 3) Colorado Yampa Coal Company outlined steps to be <br />implemented to identify the source of the problem including the <br />initiation of treatability studies. Based upon findings from <br />the treatability studies, the applicability of available <br />treatment methods will be evaluated and a specific treatment plan <br />developed. Further study indicated the problem may have been an <br />analytical one and the labs procedures have been modified to <br />reduce this type of error from reoccurring. <br />A civil penalty of $1,260 per violation was set and this civil <br />penalty was paid on October 6, 1986. <br />Alleged Violation Identification: Notice of Violation and Cease <br />and Desist Order of NPDES Permit No. CO-0027154 <br />.
