McArdle <br />April 17, 1981 <br />Page 2 <br />mining by the pond method will require 253 to 40`~ greater land <br />disturbance and a resultant increase in costs to the consumer. <br />The pit will be mined in stages with ongoing reclamation phases, <br />but the creation of numerous small pits is not part of the <br />mining plan nor a desirable end result for the planned reclama- <br />tion. <br />2, "The pit should contain an island(s) and an irregular <br />bottom and shoreline with peninsulas." The reclamation plan <br />includes irregular shorelines and irregular bottom. It is <br />hoped there will be enough waste material to create one or two <br />peninsulas. If there are large amounts of waste material (which <br />is not expected), it would be possible to create some islands. <br />3, "No activity should occur within 100 feet of the over- <br />flow channel and wetland area." Construction of a ditch by <br />others on their property along the east and northeast sides of <br />the operator's property has reduced water access to the site <br />through these overflow channels. When mining starts, the pit <br />area will be dewatered so that mining will be done under semi- <br />dry conditions. This will not be a wet dragline operation. <br />The material in place is already short of desirable fines; a <br />dragline operation causes loss of a great deal of the fine <br />material back to the wet pit. Draglining is an unacceptable <br />method under these conditions. Water will not be permitted to <br />overflow onto the operating area of the pit. <br />4. "All cottonwood trees adjacent to the river should be <br />preserved and a minimum setback of 100 feet from the river <br />should be maintained in order to save important bald eagle <br />perches." Reference is made to Map Exhibits D-1 and F. The <br />planned setback from the Colora do River is 100 feet. There <br />are few trees in the setback area; those that exist will be <br />preserved. <br />5.
