<br />J-Bar-B, Inc. <br />File No. M-84-099 <br />August 23, 1984 Board Meeting <br /> <br />Purpose: Today we are here to consider the 112 permit application for <br />J-Bar-B's proposed sand and gravel mine in Weld County, Bailey Pit. <br />Background: The proposed operation encompasses 217 acres located <br />approximately eight miles east of Longmont, Colorado in Weld County. The <br />proposed excavations will take place on both the north and the south of Saint <br />Vrain Creek. The existing land use is irrigated agriculture, grazing, <br />residential and wildlife habitat. The proposed postmining configuration <br />includes the establishment of seven lakes; total surface area of the lakes will <br />be 127 acres. The lakes have been configured to avoid encountering three gas <br />pipelines which cross the subject property. <br />Recommendations: The staff has reviewed the application in detail and one <br />issue remains to be resolved. The question of permanent man-made structures <br />within 200 feet of the permit boundary whose stability might be in jeopardy <br />because of this operation. I direct your attention to the map: <br />a. The three gas pipelines; <br />b. The two county roads; <br />c. The house and outbuildings; and <br />d. The irrigation ditch. <br />The staff recommends approval of the permit with three stipulations. The <br />stipulations have been typed to make it easier for your review. <br />The unbackfilled highwall of the excavation cannot exceed 1000 <br />feet around the perimeter. <br />2. The maximum unreclaimed disturbance on site cannot exceed <br />77 acres. In addition, the maximum acreage for areas to be <br />revegetated cannot exceed 36 acres. <br />3. The Mined Land Reclamation Board recommends that all mine <br />operators check compliance of their mining operation(s) with <br />State water law. If mining commences without prior compliance <br />with applicable State water laws, the State Engineer may take <br />enforcement action. <br />The reasoning for the first two stipulations is based on the limitations <br />presented by the operator in the reclamation cost estimates. The Division has <br />not yet received comments from the State Engineer, therefore, the third <br />stipulation is necessary. <br />The staff recommends the financial warranty be set at $73,000.00. <br />/baw <br />Doc.
