~ III IIIIIIIIIIIII III ~ <br />999 <br />MINUTES, AUGUST, 1984 PAGE 14 <br />-AGENDA ITEM 77 - CORN CONSTRUCTION, CONTINUED: <br />It was MOVED that the Board deny the request for release of financial warranty <br />from Corn Construction, File No. 79-052. SECONDED and PASSED UNANIMOUSLY. <br />- AGENDA ITEM 78 -CORN CONSTRUCTION, FILE N0. 76-24 <br />Staff presentation was made by Reclamation Specialist, Carol Russell, <br />regarding a request for release of financial warranty. This is an 11 acre <br />sand and gravel operation in Mesa County, just south of Grand Junction. This <br />pit was also breached by the river in 1983. Partial release was approved by <br />the board on this pit previously. Slides were shown. Staff recommended <br />denial of the request. Staff further indicated that the operator is planning <br />to come in with a revision on this item also. <br />It was MOVED that the Boad deny the request for release of financial warranty <br />from Corn Construction, File No. 76-24. SECONDED and PASSED UNANIMOUSLY. <br />BOARD MEMBER, Chips Barry, left the meeting. <br />- SUNSHINE ITEM - J-BAR-B, INC., FILE N0. M-84-099 <br />Staff presentation was made by Reclamation Specialist, Carol Russell, <br />regarding a 112 permit application for a 217 acre proposed sand and gravel <br />operation in Weld County, about eight miles east of Longmont. Staff gave a <br />brief description of the mining and reclamation plans and directed the board's <br />attention to the question of permanent man-made structures within 200 feet of <br />the permit boundary whose stability mi ht be in jeopardy because of this <br />operation; 1) three gas pipelines, 2}~ two county roads, 3) house and <br />outbuildings, and 4) an irrigation ditch. Staff presented ATTACHMENT N, <br />correspondence from Colorado Interstate Gas Company and Pan anl~ aC. stern <br />Pipeline Company. <br />Larry O'Brian, representing J-BAR-B, Inc., addressed the board regarding the <br />man-made structures. <br />Staff recommended approval of the permit application with three stipulations: <br />1) The unbackfilled highwall of the excavation cannot exceed 1,000 feet <br />around the perimeter. <br />2) The maximum unreclaimed disturbance on site cannot exceed 77 acres. <br />In addition, the maximum acreage for areas to be revegetated cannot <br />exceed 36 acres. <br />3) The Mined Land Reclamation Board recommends that all mine operators <br />check compliance of their mining operation(s) with State water law. <br />If mining commences without prior compliance with applicable State <br />water laws, the State Engineer may take enforcement action. <br />Staff further recommended financial warranty in the amount of $73,000. <br />It was MOVED that the Board approve the permit application of J-BAR-B, Inc., <br />File No. M-84-099, with the three stipulations as indicated by staff and <br />financial warranty set at $73,000. SECONDED and PASSED UNANIMOUSLY <br />
