Mr. Tony Waldron <br />Division of Minerals and Geology <br />May 5, 2006 <br />Page 2 of 3 <br />Topsoil Salvage: The Applicant commits to salvaging at least 6-12 inches of topsoil <br />during stripping activities, and replacing at least 6-12 inches of topsoil during <br />reclamation activities. <br />6.4.5 EXHIBIT E -Reclamation Plan <br />Mulching: The Applicant commits to mulching or cover cropping all reseeded areas. If <br />mulch is used, only certified noxious weed free mulch will be used. <br />Weed Management: Attached please find a Weed Management Plan prepared for this <br />site. The Applicant commits to implement the Weed Management Plan as soon as site <br />disturbance commences, and will modify/update the Plan as necessary to prevent the <br />establishment of and/or to control the spread of noxious weeds at this site. <br />Seed Mixes: Attached please find revised Tables E-1 and E-2, containing the proposed <br />permanent and temporary native seed mixes based on your comments. We are still <br />waiting for John Valentine at the NRCS Colorado Springs Office to review the mix and <br />suggest mix percentages. We will submit the final seed mix tables to the Division prior <br />to approval of this application. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />We anticipate that the information provided in the Exhibit D section of this letter will <br />enable you to calculate a financial warranty amount. <br />Rule 6.4.19 Exhibit S-Permanent Man-Made Structures <br />Signed Structure Agreements: Enclosed please find signed structure agreements <br />with EI Paso County Telephone (underground phone line along Dearing Road), the <br />Mountain View Electric Association (above ground power lines along Dearing Road), <br />and Jeffrey and Maria Jindra (livestock fences, abandoned water trough and <br />underground water pipeline, unpaved site access roads). The Jindras also own the <br />geodesic dome building located within the permit boundary, but more than 200 feet from <br />the affected area. Oglebay will not disturb or demolish/remove the dome building <br />without prior notification to the Division. <br />Pending Dearing Road Structure Agreement: The Applicant has not yet executed a <br />structure agreement with EI Paso County for Dearing Road, but fully commits to doing <br />so prior to disturbing land within 200 feet of Dearing Road. It is the County's policy to <br />refrain from executing these types of agreements until the County Special Use permit is <br />approved. It is also the County's strong preference that the DMG application be <br />approved prior to scheduling a Board of County Commissioner's hearing for the project. <br />Because of this Catch-22, we request that the Division place a stipulation on the permit <br />requiring the Applicant to obtain this agreement prior to affecting land within 200 feet of <br />Dearing Road. <br />Norris Livestock Fences: A barbed-wire fence owned by Robert & Jane Norris is <br />located within 200 feet of the proposed site access, as shown on Exhibit C-1.
