State Req. <br />• C. Conclusions <br />Seneca Coals, Ltd. requests a negative determination for olluvial valley <br />floors because: <br />I. The Seneca fl Mine hos been in operation along Grassy <br />and Little Grassy Creeks for twelve years without any <br />visible disturbance to either the northern or middle <br />areas described earlier. <br />2. There has been no disruption of agricultural activities <br />due to mining. <br />3. Shallow groundwater levels remain high even after <br />mining. <br />• 4. There are no plans to mine through any of the areas <br />described along Grassy and Little Grassy Creeks in the <br />future. Only a small portion is to be disturbed in the <br />southern area; therefore, material damage to these <br />areas will be minimal. <br />5. Historic land use indicates if these areas were eco- <br />nomic to irrigate, they would have been developed long <br />ago. <br />6. Flood irrigation water, if utilized from GrassyCreek, <br />would materially damage the alluvial soils.
