Mr. Babbitt
September 16, 1980
Page Two
pile of uncertain age (probably at least 20-30 years old by the amount of
vegetative growth on the pile) and of considerable size (about 75 to 100 feet
high and in excess of 300 feet long). I can find no evidence of a permit for
this operation in our flies.
Since neither of these two operations seems to have a mining and reclamation
permit, I intend to bring them before the Mined Land Reclamation Board during
the September 24-25 meettn9 to repuast a possible Notice of Violation and
Cease and Desist Order on each for mining with a permit to violation of the
Mined Land Reclamation Act {C.R.S. 1973. 34-32-109(7))• Please note that
uncer C.R.S. 1973, 34-32-123 {enclosed), civil penalties for mining without
a permit can be severe.
1 recommend that Fremont County have a representative at this meeting. The
meeting will be held In the City Mall Councii Chambers, 806 Cooper bvenue,
Glenwood Springs, Colorado. You may call this office on September 22, 1980
to find out more exactly the time that your case will be heard. 14 1 may
be of any other assistance to this matter, please call me.
Sincerely,
Mark 5.
