Box 439 <br />Canon City, Colorado 81212 <br />RE: District $2 Gravel Pit <br />our Flle: !79-216 ,. <br />Unpermltted Sand and Gravel Operation on Madlum Security <br />State Penitentiary Land <br />Our File: none <br />Dear Mr. Babbitt: <br />On September 1.2, 1980, 1 made Inspections of the above captioned operations. <br />Neither of them has bean permitted by the Mined Land Reclamation Board, and <br />both were In operation. <br />The District ~2 pit has had an application pending since December 28, 1979. <br />Tha application was originally filed as a regular Impact, 112 permit appii- <br />catton and, as such was Incomplete. I suggested at that time that the <br />application b® filed as a limited impact, 110 permit application (if appro- <br />priate) and this was subsequently done and Judged canplete as of January 18, <br />1980. However, the application was severely inadequate as of that date and. <br />on January 21, 1980, our Division received a letter from Dolly Duefield <br />requesting an Indefinite continuance until the application materials were <br />adequate. I wrote a latter on that same date outlining the adequacy concerns <br />in some detail. I have enclosed a copy of that letter and chocked the Items <br />that were satisfied In Ms. Dueflelds final submission to mm of June 13, 1980. <br />The application, however, Is still inadequate In the other areas outlined In <br />this letter and, as such, could not be approved by our Board. My Inspection <br />also indicated that the disturbed area is already over 10 acres and thus <br />would preclude a 110 application. My last contact on this operation was with <br />Commissioner Buglewica on August 7 and 1 have heard nothing since. <br />The other operation I inspected is on the Colorado Medium Security State <br />Penitentiary grounds, about 2 miles south of Route 50 and 5 mlfes east of <br />Canon City. Fremont County is evidently mining what seems to be an aggregate <br />
