Doc Date:12/11/2001 'll'll'I"I'III"II <br />Section 780.15 (b) Continued. <br />• <br />or its equivalent, and any deposit of dirt and mud on treated haul <br />roads will be prevented to the extent possible. <br />These measures will serve to effectively control wind erosion <br />related air pollution, while also providing a comprehensive air <br />quality control program. <br />~(` Section 780.16 Fish and wildlife plan. <br />(a) Each application shall contain a fish and wildlife plan, consistent <br />with 30 CFR 816.97 which provides: <br />• <br />(1) A statement of how the plan will minimize disturbances and adverse <br />impacts on fish and wildlife and related environmental values during <br />surface coal mining and reclamation operations, and how enhancement of <br />these resources will be achieved, where practicable. The plan shall <br />cover the mine plan area and portions of adjacent areas as determined by <br />the regulatory authority pursuant to Section 779.20(c). <br />(2) If the applicant states that it will not be practicable, in accord- <br />ance with Paragraph (1), to achieve a condition which clearly shows a <br />trend toward enhancement of fish and wildlife resources at the time <br />revegetation has been successfully completed under 30 CFR 816.111- <br />816.117, a statement shall be provided which establishes, to the satis- <br />faction of the regulatory authority, why it is not practicable to a- <br />chieve such a condition. <br />General~Stafemenf-df~Plati <br />Although pursuant to In re Permanent"Surface Mining"Regulation <br />Litigatidn F.
