Section 780.15(a) <br />• (1) An air quality monitoring program to provide sufficient data to <br />evaluate the effectiveness of the fugitive dust control practices pro- <br />posed under Paragraph (a)(2) of this Section to comply with Federal and <br />State sir quality standards; and <br />(2) A plan for fugitive dust control practices as required under 30 CFR <br />816.95. <br />As indicated by Table 53, Anticipated Annual and Total Coal Pro- <br />duction, Kerr Coal's annual production rates will at no time during <br />the term of this permit exceed one million tons of coal per year. <br />In fact, Kerr Coal's production rates are not projected to exceed <br />750,000 tons per year. Accordingly, 30 CFR 780.15 (a) has no appli- <br />cability to this Permit Application. <br />• <br />(b) For all other surface mining activities the application shall <br />contain an air pollution control plan which includes the following: <br />(1) An air quality monitoring program, if required by the regulatory <br />authority, to provide sufficient data to evaluate the effectiveness of <br />the fugitive dust control practices under Paragraph (b)(2) of this <br />Section to comply with applicable Federal and State air quality stan- <br />dards; and <br />(2) A plan for fugitive dust control practices, as required under 30 <br />CFR 816.95. <br />Kerr Coal Company holds emission permits from the Colorado Air <br />Quality Control Commission with respect to both the Kerr Mine and <br />Kerr Tipple Areas. These permits are identified in Section 778.19 <br />I <br />780-35 <br />
