<br />Revised 04/20/90 <br />Section 780.12(b) Continued. <br />Pursuant to Section 816.97 (b), Kerr Coal proposes the following <br />compliance plan for the two existing power lines. According to REA <br />Bulletin 61-10, Power Line Contacts by Eagles and Other Large Birds, <br />prepared by the USDA, Kerr Coal will not have to reconstruct or <br />modify the existing Marr Mine Area power line for compliance. <br />However, two power.poles at the tipple area will need to be <br />reconstructed. As shown on Map 29, Kerr Tipple Area Existing <br />Structures, there are only two transmission line power poles within <br />the Kerr Tipple Area. The design specifications for reconstruction <br />are shown in Figure 17, Proposed Raptor Proof Power Pole Diagram <br />Kerr Coal plans to make the proposed modifications to the two power <br />poles at the Kerr tipple in May, 1981. The time necessary For <br />reconstruction will be approximately one week. After the power pole <br />modifications have been made, Kerr Coal will regularly monitor the <br />poles to assure that the performance standards of 816.97 (b) are <br />continuously met. The reconstruction work will be done by qualified <br />electricians to assure that risk of harm to the public health and <br />safety is not significant. <br /> <br />Haul Roads <br />There is one existing haul road in the permit area as shown on Map <br />1, Kerr Mine Area Mine Plan. It runs from the existing pit <br />approximately two miles north to Jackson County Road 12E. From there <br />the haulage leaves the permit area and runs west about 10 miles to <br />State Highway 14, then south about one mile to the Hines-Moran <br />private roadway, then west about 1/4 mile to the Kerr Tipple Area. <br />Section 816.150(a) explains why the Hines-Moran private roadway is <br />not included in the proposed permit area. <br />The existing haul road was constructed in the fall of 1974. The <br />northern most 1/2 mile of the road is a former Jackson County paved <br />road. The rest of the road is surfaced with existing gran- <br />780-23 as <br />
