(k) Refirse,~ Toxic Prortucing Materials. Applicant's operations are not expected to
use or generate refuse or acid- ortoxic-producing materia]s. None are expected to be exposed
during operations.
(1) Disturbance to Hi~rlrologic Balance. To Applicant's knowledge, the Brown
Derby Mine is dry year around. There are no springs, lakes, ponds or ditches on or near the
affected lands other than the intermittent stream described in Paragraph (c) of Exhibit B -Site
Description. Applicant's operations do no[ require water, except for minimal quantities
necessary for occasional drilling purposes, as described above in Paragraph (h). Accordingly,
Applicant's operations are not expected to have any affect on the hydrologic balance in the area.
Because Applicant's operations are not expected to create any surface disturbance or to disturb
any hydrologic balance, and because the proposed future use of the land is the same as the
current use, i. e., rangeland, Applicant is no[ proposing any special measures during the life of the
mine to minimize disturbance [o the hydrologic balance or provide a stable configuration of
affected areas for future reclamation.
(m) On-Site Processing. Tourmaline specimens do not require any processing prior to
sale or use. Lepidolite ore will not be processed at the Mine. Instead, lepidolite ore will be
transported from the Mine to another location in Gunnison County for washing and screening.
Accordingly, there are no process areas or structures shown on Exhibit E -Map.
(n) Primary Contmortities. The known commodities [o be extracted from [he Mine
are gem quality and sub-gem quality tourmaline specimens and lepidolite. The tourmaline
specimens will be sold to or traded with gem and rock collectors. Lepidolite, when washed and
screened, will be packaged in proprietary containers and marketed as lithium salts.
(2) TAILINGS PONDS
There will be no construction of tailings ponds or related facilities. All washing and screening
will occur offsite as described in Section (1) above.
Exhibit C - 5
