Long <br />Division Director <br />The Division of Minerals and Geology received your adequacy response to the Tellier Gravel Pit <br />Permit Application, File No. M-98-0~8. <br />The following concerns need to be addressed; <br />Two easement holders were notified of the operation on October l7, 1998. The applicant will <br />need to obtain a written waiver from the Yampa Valley Electric Association and US West of <br />their right to the 41 day comment period. If the applicant is unable to obtain the written <br />waivers, [he decision due date will need to be extended an additional 41 days to allow for <br />comments. <br />2. The applicant has provided documentation of an agreement with Public Service Company to <br />install strain gauges and provide for monitoring of the gauges by Public Service Company. <br />The applicant further commits to provide copies of the strain gauge reports to the Division. <br />This plan is acceptable, but must be clearly described in the permit. The Division suggests <br />that the applicant provide copies of all strain gauge data with each annual reclamation report, <br />with the exception of cases where unacceptable strains are detected by the gauges. ]n this <br />case the Division must be notified within 24 hours after the applicant has knowledge of the <br />problem (Rule 8.l ). The Applicant must further commit to maintenance of a minimum 200- <br />foot setback from the pipeline until the strain gauges are installed and initial readings <br />recorded. <br />3. The applicant states that there is a remote potential for nine percent of the mine are to <br />potentially lower the elevation of the Anderson's well since the bottom of the pit floor is <br />below the elevation corresponding to their well. The Division agrees with the applicant that <br />there is a remote potential for the proposed mining operation to adversely affect the <br />Anderson's well because of the depth and location of the pit in relation [o the well. <br />COLORADO <br />However, the applicant must demonstrate that impacts to the hydrologic balance of the <br />surrounding area have been minimized, per Rule 3.1.6(1). This may be demonstrated by <br />locating and monitoring a well between the pit area and [he Anderson's well prior to <br />
