<br />Page 27 <br />(6) Brief description of reclamation plan for the <br />excavated area in accordance with other permits or requirements; <br />and <br />(7) Any other information which the Division believes <br />would aid its determination. <br />1.14.2 The Division will determine whether a <br />reclamation permit is necessary for each request on a <br />case-by-case basis and will respond in writing within three (3) <br />weeks of submittal of any information the Division may request. <br />1.14.3 Any such decisions made by the Division may be <br />appealed and reconsidered by the Board or Division if the appeal <br />and the reasons for the appeal are submitted to the Division. <br />If such an appeal request is submitted, and if the Division does <br />not reconsider tite matter to the satisfaction of the appellant, <br />then the matter will be considered by the Board at their next <br />regularly scheduled meeting. <br />1.14.4 Any determination made pursuant to this <br />section 1.14 may be reviewed and rescinded if appropriate by the <br />Division or Board at any time that: <br />(1) Additional information regarding the applicant's <br />activities becomes available indicating that they diverge in any <br />manner from the submittal; or <br />(2) The character of the activity changes significantly <br />in nature or scale. <br />(3) Any deviation, if it constitutes mining, may be <br />found to be mining without a permit within the meaning of these <br />Rules. <br />
