Any person, company, or agency desiring to <br />\~ excavate construction or aggregate materials is strongly <br /> encouraged to inquire with the Division as to whether their <br /> operations require a reclamation permit. <br /> 1.14 Process for Determining Necessity fora Reclamation Permit <br /> 1.14.1 In such cases where it is unclear whether a <br /> reclamation permit is required, any person, company, or agency <br /> may file a request with the Division fora determination as to <br /> whether a reclamation permit is required. Such requests must be <br /> submitted in writing and include the following information: <br /> (1) Statement that a determination is requested as to <br /> whether a permit is required; <br /> (2) Legal description and general location of the <br /> project; <br /> (3) Brief narrative describing general nature and <br /> primary intent of the project, size and duration of excavations, <br /> and quantity and description of excavated material; <br /> (4) Proposed use of the excavated material including <br /> whether it will be sold, traded, given away, or used on-site, <br /> and the general location or specific project where material will <br /> be used or transported to, if known; <br /> (5) Evidence of other required and obtained permits; <br />
