The applicant should also
specify the slope dimensions to be maintained during mining of the surrounding, adjacent lands. (The
Division recommends adoption of a minimum berm width (or setback distance) of 10 feet from the edge of
each stream bank and excavation at no steeper than a 1:1 slope). Please respond.
4. The Division requests that the following criteria be followed in re-establishing reclaimed stream banks
of Sandy Creek: slopes less than or equal to five (5) feet in height will be reestablished at a 1:1 slope,
slopes greater than five (5) feet in height will be reestablished at a 2:1 slope.
5. The Division recommends that the applicanUoperator leave, where feasible, existing mature cottonwood
trees and/or other large, native woody vegetation.
6.4.12 EXHIBIT L -Reclamation Costs
6. The applicant proposed reclamation cost estimate will be evaluated using the Division's reclamation cost
estimating program to include indirect costs.
Once again, I will look forward to your response on or before June 2007 to allow adequate time for review
before the June 11, 2007 decision date. Rule 1.8.1 states that changes and additions to the permit
application must be filed with the Division and the County Clerk and Recorder. The applicant must also
provide the Division with an affidavit or receipt demonstrating that the change or addition was filed with
the County Clerk and Recorder no later than the close of business on the day the change was filed with the
Division.
Please contact me at (303) 866-3567 if you have any questions.
Sincerely,
~~~~~~~ ~y=~~~~~
Thomas Ate.
