Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are remaining adequacy review comments on the above-captioned Regular 112 Application <br />for 68 permitted acres. The decision date for your application is scheduled for June 5, 2007. Therefore, I <br />would appreciate a response from you on or before June 1, 2007 (Your response should include two (2) <br />copies). Please be advised that your conversion application may be deemed inadequate and may be denied <br />on June 5, 2007 unless the following adequacy review items are addressed to the satisfaction of the <br />Division. <br />6.4.4 EXHIBIT D -Mining Plan <br />1. The Division is agreeable to the applicant mining the site in three (3) distinct stages, and mining through <br />the existing intermittent stream channel (Sandy Creek) provided the applicant will commit to the following <br />measures: <br />• The entire boundaries of the north and south bank of the stream channel will be clearly marked <br />prior to excavation. <br />• The operator will excavate the stream channel within each section first, and reestablish the <br />boundaries of the channel including north and south banks prior to excavation in the surrounding <br />areas. <br />• Following excavation and re-establishment of the stream channel banks and channel dimensions, <br />the operator will conduct a representative cross-sectional survey of the re-established stream <br />channel to verify re-establishment ofpre-mining channel dimensions. <br />6.4.5 EXHIBIT E -Reclamation Plan <br />2. The Division requests that the operator commit to providing the Division with apost-mining stream <br />channel survey for each of the three (3) sections to be mined prior to approval of final bond release. Please <br />respond. <br />3. The Division requests that the applicant provide a revised channel dimension cross-section, for each of <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction Durango Active and Inactive Mines <br />
