Page 24 <br />Hard Rock/Metal Mining Rule 1 <br />(d) ,the public, by newspaper release, and posting as prescribed in <br />Subparagraph 2.2.1(a)(iii). <br />(3) The Office shall send notice of the date, time and place of any Pre- <br />hearing Conference to: <br />(a) the Applicant; <br />(b) all persons that submitted timely statements in support of or <br />objections to the application and a basis for party status; and <br />(c) the Board of County Commissioners and the applicable soil <br />conservation district. <br />u5 (t) (4) The Office shall provide notice of the date, time, and place of any <br />application heazing by the Boazd, by: <br />(a) sending written notice to the Applicant, any person previously <br />filing a protest or petition for a hearing or statement in support of the <br />application, and the local Boazd of County Commissioners; <br />(b) publishing notice in a newspaper of general circulation in the <br />locality of the proposed mining operation once a week for two (2) consecutive <br />weeks immediately prior to the hearing; and <br />(c) mailing list, newspaper release, and posting as prescribed in <br />Subparagraph 2.2.1(a)(iii). <br />1.6.2_ General Applicant Procedures <br />(1) The Applicant shall: <br />(a) Prior to submitting the application to the Office, send a notice, <br />on a form approved by the Board, to the local Boazd of County <br />Commissioners and, if the mining operation is within the boundaries of a soil <br />conservation district, to the Boazd of Supervisors of the sots conservation <br />district. <br />(i) The Applicant shall include proof of such notice with <br />the application at the time the application is submitted to the Office. <br />
