Box 2167 <br />1800 North Taft Hill Road <br />Fort Co111ns, Colorado 80522 <br />Re: Amendment (Pending) - File No. <br />File No. <br />File No. <br />Dear Mr. Refer: <br />M-77-439 <br />M-77-440 <br />M-78-25Q1o <br />Thank you for the maps received January 30, 1986, As we discussed, these are <br />very helpful, however, a full amendment is required in order to combine the <br />various separate existing permits. <br />The existing permit files are confusing and inaccurate, in fact, deviations <br />from the permits technically constitute violations. We feel that it is <br />preferable to amend the permits to reflect present-day conditions rather than <br />to pursue any type of enforcement action, Also, it seems that since the <br />various areas are adjacent to one another, it makes sense to combine the areas <br />into one permit. The company should realize savings in annual fees over the <br />long term by such a combination. Your company may also wish to request <br />partial release on areas if they are completely reclaimed. <br />We would like to recommend the following course of action: <br />1. All three existing permits (77-439, 77-440, 78-256) should be combined <br />into one particular permit, by way of an amendment. You should choose which <br />original permit will be amended, perhaps based upon anniversary date or some <br />other logical criteria. <br />2, We would revuire that all annual fees and reports be submitted for the <br />original permits prior to final amendment approval, <br />3. An amendment fee must be submitted based upon the total amended acreage. <br />The fee schedule will be found in Rule 1.8 of the Mineral Rules and <br />Regulations. <br />4. All permit exhibits will be included as per the requirements ot` Rule 2 of <br />the Minerals Rules and Regulations.
