Exhibit G states that a substitute supply plan has been <br />acquired for phase 1 and that an application will be submitted <br />to the Division of Water Resources before Phases 2 and 3 are <br />mined. The operator will need to submit proof of compliance <br />with the State Engineer before disturbing the groundwater in <br />either phase 2 or 3. This can be in the form of verification <br />of the well permit and application for the well <br />permit/augmentation plan and notification that the permit has <br />been issued. The Division may include this as a stipulation <br />to permit issuance. <br />12. Pursuant to C.R.S. 34-32-116(7)(g), the Division is concerned <br />that disturbances to the hydrologic balance and to the quality <br />and quantity of groundwater be minimized during and after the <br />mining operation. The well data in Exhibit G indicates that <br />there are several shallow wells adjacent to or near all <br />phases of the mining plan. Exhibit G states that no injury is <br />anticipated to the surrounding water rights due to the <br />presence of the slurry wall. <br />The application states there will be no slurry wall around <br />Phase 1 when it is dewatered. For Phase 1, the applicant will <br />need to either provide a groundwater analysis which <br />demonstrates that there will be no or minimal impact to the <br />nearby wells or submit a monitoring and mitigation plan for <br />potentially impacted well owners. If a monitoring plan is <br />submitted, it needs to include a schedule for monitoring <br />groundwater levels and identify the well or piezometer <br />locations to be monitored. The plan also must define what <br />will be considered an impact to the well and what mitigation <br />action will be followed when it is determined wells have been <br />impacted. <br />Regarding Phases 2 and 3, it is not clear if the .slurry wall <br />will be installed prior to mining the 4 acre settling pond <br />area in the southern portion of Phase 2. Several wells <br />located south, east and west of this area potentially would be <br />impacted if the slurry wall is not in place when mining begins <br />in this area. Please clarify and, if the slurry wall will not <br />be in place, provide a groundwater analysis which demonstrates <br />
