Box 721, Lamar, CO 51052, <br />W I T N E S S E T H <br />2n consideration of the sum of One Dollar (S 1.00) and other valuable <br />considerations, receipt of which is hereby acknowledged, Lessor hereby leases <br />to Lessee the tract of land shown below from the date of the lease until the <br />29~ day of DECEMBER, 2009 at 12:00 noon for the purpose of quarrying, <br />mining, removing and marketing from there all sand, gravel, rock and other. <br />construction materials. Said land is situated in the COUNTY OF__CROWLEY , in <br />the State of Colorado, and is described as: <br />WEST '-2 OF NORTHWEST 'a OF SECTION 15, TOWNSHIP 22 SOUTH, RANGE 58 WEST <br />NORTH ~3 OF SECTION 16, TOWNSHIP 22 SOUTH, RANGE 58 WEST <br />NORTH '2 OF SECTION 17, TOWNSHIP 22 SOUTH, RANGE 58 WEST <br />NORTH 'tea OF SECTION 18, TOWNSHIP 22 SOUTH, RANGE 58 WEST <br />SOUTH '~3 OF THE SE 'tea OF SECTION 8, TOWNSHIP 22 30UTH, RANC-E 58 WEST <br />~1. PRICE: Lessee shall pay ORDWAY FEEDYARD, LLC monthly on or before <br />the 10th day following each month for gravel and overburden hauled from the <br />premises at the sum of <br />Lessee shall maintain records of truckloads hauled from the premises, which <br />shall be furnished to Lessor, and each truck hauling material will be <br />designated on Lessee's records. Lessee will cause test loads for each trucY, to <br />be weighed at Lessor's reguest. However, it is not the intention of the parties <br />that each truckload be weighed. <br />2. ACCESS: Lessee shall have the right of ingress and egress to and <br />from the premises on roads presently located on said tract or upon roads <br />constructed by Lessee together with the right to erect-temporary structures <br />such as screening and crushing plants, asphalt plants and other structures <br />necessary to remove and process gravel. <br />3. OPTION TO RENEW: Lessee shall have the right and option to renew this <br />Lease for successive periods of five (5) years each as long as the property is <br />being actively mined. Not to exceed. a total of 15 years. Renewal price will be <br />increased the same percent as the average sales price for rock has increased <br />during the first five year period for example: if our roc k_ sales price increase <br />305 the royalty will increase 30~. <br />a.
