THIS LEASE, Ivfade on ORDWAY FEEDY CARDER, INC., a Colorado LESSEE, tha 29~' da_y of Dec=_mb_r, 2004 , Betwsen ?AD, LLC, O_RDWAY', CO 81063 ,LESSO?, and Corporation, P.O. Box 721, Lamar, CO 51052, W I T N E S S E T H 2n consideration of the sum of One Dollar (S 1.00) and other valuable considerations, receipt of which is hereby acknowledged, Lessor hereby leases to Lessee the tract of land shown below from the date of the lease until the 29~ day of DECEMBER, 2009 at 12:00 noon for the purpose of quarrying, mining, removing and marketing from there all sand, gravel, rock and other. construction materials. Said land is situated in the COUNTY OF__CROWLEY , in the State of Colorado, and is described as: WEST '-2 OF NORTHWEST 'a OF SECTION 15, TOWNSHIP 22 SOUTH, RANGE 58 WEST NORTH ~3 OF SECTION 16, TOWNSHIP 22 SOUTH, RANGE 58 WEST NORTH '2 OF SECTION 17, TOWNSHIP 22 SOUTH, RANGE 58 WEST NORTH 'tea OF SECTION 18, TOWNSHIP 22 SOUTH, RANGE 58 WEST SOUTH '~3 OF THE SE 'tea OF SECTION 8, TOWNSHIP 22 30UTH, RANC-E 58 WEST ~1. PRICE: Lessee shall pay ORDWAY FEEDYARD, LLC monthly on or before the 10th day following each month for gravel and overburden hauled from the premises at the sum of Lessee shall maintain records of truckloads hauled from the premises, which shall be furnished to Lessor, and each truck hauling material will be designated on Lessee's records. Lessee will cause test loads for each trucY, to be weighed at Lessor's reguest. However, it is not the intention of the parties that each truckload be weighed. 2. ACCESS: Lessee shall have the right of ingress and egress to and from the premises on roads presently located on said tract or upon roads constructed by Lessee together with the right to erect-temporary structures such as screening and crushing plants, asphalt plants and other structures necessary to remove and process gravel. 3. OPTION TO RENEW: Lessee shall have the right and option to renew this Lease for successive periods of five (5) years each as long as the property is being actively mined. Not to exceed. a total of 15 years. Renewal price will be increased the same percent as the average sales price for rock has increased during the first five year period for example: if our roc k_ sales price increase 305 the royalty will increase 30~. a.
