Mr. Joe Kurys • - 4 - <br />Exhibit D (cont'd> <br />September 2, 1992 <br />The applicant should specify the ma:<imum gradient that any reclaimed <br />surface within the permit area will have. If all areas are to be <br />returned to a level condition by the reclamation, the applicant should <br />sdy 50. <br />As indicated before, there is no commitment to salvage, stockpile and <br />stabilize topsoil (i.e., plant growth medium). The applicant should <br />commit to the salvage, stockpiling and stabilizing a certain thickness of <br />topsoil from the site if this is intended. <br />There is no acceptable revegetation plan, i.e., how the site will be <br />prepared, the seed mix used, the application rate, mulching employed, <br />etc. There are only statements the*. no seeding will be done and natural <br />vegetation will reestablish itself. The Division does not consider such <br />revegetation of a reclaimed area, with the potential that this <br />revegetation may largely consist of ~,veeds, will satisfy the intent of <br />Rule 6.5(1). While Rule 6.5(1> indicates that a preference for use of <br />species native to a region in any revegetation effort, Rule 6.5(6) <br />requires that weed growth be controlled during revegetation in order to <br />enhance development desired vegetation and eliminate spread of weeds to <br />nearby areas. <br />The applicant must provide a revegetation plan which can be based on <br />recommendations of the local Soil Conservation Service but which provides <br />for the revegetation of the reclaimed area by desired species. <br />Exhibit ~ <br />The maps labeled Exhibit E do not include that portion of the prepo<ed <br />permit area in ME SW Section 32, i.2., that 11.96 acres north of East <br />Drive adjacent to the Willow Crest `lursing Home Site. The permit <br />boundaries and affected area boundaries are not all outlined and labeled <br />on the Exhibit E maps nor are the proposed locations of the pit together <br />with topsoil, overburden, and product stockpiles, ditches, etc. <br />Exhibit E maps should include all the permit area, have the permit <br />boundaries and intended afrected areas outlined ane labeled. The pits, <br />stockpiles, ditches, etc., should be outlined and labeled; the reads <br />clearly indicated. Direction of mineral extraction should be indicated <br />Cn 311 tracts. The thiCknes; Of re^1dCed O`/e rbUYden ds ~,vell d: top5p11 <br />should be indicated. <br />Exhibit G <br />The Division is accepting evidence provided of the city being the lessor <br />of the approximate 11.96 acre tract in the NE SW of Section 32 (i.e.,17 <br />acres lass 5.04 acres) as indicating c~~~nership by the city. The Division <br />is also accepting evidence cf the our,=base of a >ix-acre tract in the ~YW <br />SW VW of Section 32 by the city as indicating ownership or the tract by <br />the city. The permit application, however, does not contain evidence of <br />ownership or right of entry to the 4 acres (possibly 6.5 acre> tract in <br />the S1J r'1W of Section 32 immediately north or Pond 1. <br />
