<br />THIS DEED, made this day of September, 1997 between the American Cancer Society,
<br />Colorado Division, lnc., a Colorado non-profit corporation, whose address is 2255 S. Oneida, Denver,
<br />Colorado 80224 and American Heart Association of Colorado, Inc., a Colorado non-profit corporation,
<br />whose address is 1280 South Parker Road, Denver, Colorado 80231 ("Grantors") and Daren R. Stone and
<br />Kathy J. Stone, 24600 County Road P., Cortez, Colorado 81321 ("Grantees").
<br />WITNESSETH, that the Grantors, for and in consideration of the sum of Five Thousand and 00/ 100
<br />Dollars ($5,000.00), the receipt and sufficiency of which are acknowledged, have granted, bargained, sold
<br />and conveyed, and by these presents do grant, bargain, sell, convey and confirm, unto the Grantees, their
<br />heirs and assigns forever, the following real property situate in the County of Montezuma, State of Colorado,
<br />to wit:
<br />The oil, gas and other minerals lying in o: under or that may be produced from the Soh SE'/. of
<br />Section 12 and the N'h NE'k of Section 13, Township 35 North, Range 17 West, N.M.P.M.,
<br />containing 320 acres more or less; gross and net.
<br />TOGETHER with all and singular the hereditaments and appurtenances thereto belonging, or in
<br />anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits
<br />thereof; and all the estate, right, title, interest, claim and demand whatsoever of the Grantors, either in law or
<br />equity, of, in and to the above bargained mineral interests;
<br />TO HAVE AND TO HOLD the said premises above bargained and described, unto the Grantees,
<br />their heirs and assigns forever. The Grantors for themselves, their successors and assigns, do covenant and
<br />agree that they shall and will WARRANT AND FOREVER DEFEND the above-bargained premises in the
<br />quiet and peaceable possession of the Grantees, their heirs and assigns, against all and every person or
<br />persons claiming the whole or any pan thereof, by, through or under the Grantors, subject, however, to any
<br />mineral leases, patents, reservations of record, if any, and any claimed interest of the surface owner.
<br />IN WITNESS WHEREOF, the Grantors have executed this deed on the date set forth above.
