• <br />33 <br />LEGAL RIGHTS TO ENTER & MINE <br />SEC 12 & 13, T35N, R17W, NMPM <br />STONE GRAVEL PTT <br />DARENSTONE-PROPRIETOR <br />EXHIBIT N <br />Stone Gravel Pit site is located on lands the surface estate of which is owned by the <br />United States of America, in the caze of the Bureau of Land Management (BLM), <br />Department of the Interior. The sand & gravel portion of the surface estate having been <br />reserved by the previous owners to themselves in their reconveyance of the surface estate <br />to the United States, was sold with the entire mineral estate to Kathy J. Stone and Daren <br />R. Stone, the applicant for this permit. A copy of their Special Warranty Deed follows on <br />the next two pages. BLM in their following letter (Page 36) of May 27, 1997, <br />acknowledges the right of the mineral and sand & gravel owner to use the surface, without <br />the need for any special permit or other accommodation, for "...the development of <br />minerals", which in this case also includes sand & gravel. BLM has requested input into <br />the planned surface restoration following the mining activities, and regarding the <br />preservation of potential cultural sites. The applicant has honored this request. <br />
