The permittee shall safeguard with fences, barriers, fills, covers, or other effective devices, any shafts, pits, <br />tunnels, cuts, and other excavations which otherwise would unduly imperil the lives, safety, or property of oltrer <br />persons. <br />1 t), Upon abandonment, termination, or revocation of this permit, the permittee shall remove all structures and <br />facilities wtrich Have been placed on the premisas by him, and shall restore the site, unless otherwise agreed <br />upon in writing or in this permit. <br />11, Phis permit maybe suspended or terminated upon breach of any of the conditions herein or at the discretion of <br />the Authorized Officer. <br />12. The permittee shall fully repair all damage, other than ordinary wear and tear, to roads and trails in the national <br />forests caused by the permittee in the exercise of the privilege granted by this permit. <br />13. In case of change of address, permittee shall immediately notify the Authorized Officer. <br />14. No rmernber of or Delegate to Congress or Resident Commissioner shall be admitted to any stare or part of this <br />permit or to any benefit that may arise therefrom, but this provision shall not be construed to extend to this permit <br />if made with a corporation Tor its general benefit. <br />15. The permittee shall indemnify and hold I~amless the United States against any liability for damage to life or <br />property arising from the occupancy or use of National Forest System lands under this permit. <br />16. Mountain Coal Company (MCC) will post signs at the Sylvester Gulch AN trailhead to notify ttre public of <br />seismic operations. Suggostcd wording is: "Seismic Survey in Progress. Caution: Explosives in Use" <br />17. MCC will utilize seismic methods described in the Environmental Strategies Corporation (ESC) "Proposal to <br />USf'S to Perform Field Exploration, Sylvester Gulch Light Use Road". pages 5 and 6. <br />1t1. ATV's and/or snow machines permitted in MCC's Annual Operations Plan (AOP), Modification No. 4. will be <br />used.for this work. <br />Adiministration and General Considerations ., <br />1 g. The Permitted shall notify tho Paonia District Ranger at least one week before operations are to commence of <br />National Forest lands: Notif;calion shall also be given within 2 days of when the project will be completed. <br />20. The permittee will have a designate4 representative on the job site when work activity is occurring. Changes <br />in the representative must be made in advance in writing to the Poania District Ranger. This representative <br />will have a set of plans and the permit on the work site et all times during the operation. <br />Erosion and Sedimentation Considerations: <br />21. Any drill cuttings produced from these shallow holes shall be confined to the immediate area of the hole and <br />away from the ephemeral stream channel in the drainage. <br />22. Disposal of trash will be to a certified dump site off forest. <br />23. Spills of fuels, oils and other contaminants will be mitigated by immediate cleanup of all spills, with <br />contaminated matarial being neutralized or hauled to an approved dump site. <br />24. The pcrrnitlee shall seed any ground disturbance off-trail with an approved Forest Service seed mixture. <br />Cnnsieferatinns Specific. to Seismic. Operations: <br />25. A map of the proposed seismic survey sites has been provided with ESC's "Proposal to USES to perform <br />Field Exploration, Sylvester Gulch Light Use Road". <br />26. It is anticipated that it will require a maximum of two weeks to complete the seismic portion of this project. <br />27. Upon approval of this application and prior to startup of the seismic survey work, MCC shall provide written <br />infonmation for the geophysical contractor for this work, including but not limited to: name, address, and phone <br />number (office/field, day/night) of person responsible for the storage, transportation, and use of explosives; <br />and the joumeyrman or qualified blaster who will supervise blasting on the jobsite. <br />2ti. Also, provided witty ttris information will be a description of the protective measures to he used to protect the <br />puhlic, and wildlife in the area where explosives are to be used. This will include a description of the <br />protective measures to be used for loaded shotpoints, to assure that each shotpoint is safe after detonation. <br />Page 2 of 3 <br />
