<br />13. Any controversy or claim arising out of or relating to this contract, or the breach <br />thereof, shall be settled by arbitration conducted under the provisions of the Uniform Arbitration Act <br />of 1974 [§13-22-201, et. se ., C.R.S.] as modified and changed however by the provisions hereof. <br />In the event of conflict with any provision of this paragraph and the provisions of the Uniform <br />Arbitration Act, the provisions of this paragraph shall control. Any judgment so rendered by the <br />arbitrator(s) may be entered in any court having jurisdiction thereof. The following provisions shall <br />also be applicable to arbitration under this paragraph: <br />(a) Tn the event of controversy between the parties as to what issues or disputes <br />are subject to arbitration hereunder, that controversy shall also be determined by arbitration <br />hereunder. <br />(b) In the event of controversy between parties as to the validity of this arbitration <br />clause, that controversy shall also be determined by arbitration hereunder. <br />(c) Arbitration hereunder shall be conducted by three arbitrators unless the parties <br />agree on the use of a single arbitrator. The procedure for selection of the arbitrators shall be as <br />follows: Each party shall select an arbitrator and they, in turn, shall select the third. If they cannot <br />agree on the third arbitrator, a judge of the Ninth Judicial District of the State of Colorado, upon <br />application, shall make the appointment. If the parties agree to use a single arbitrator but cannot <br />agree on his or her identity, again, upon application, a judge of the Ninth Judicial District of the State <br />of Colorado shall make the appointment: <br />(d) Arbitration hereunder shall be held at Meeker, Colorado unless the parties <br />agree on another location; <br />o:vrnrnmconrnc,~enoryrEn 7 n~nR s, rs~ <br />
