<br />is permitted to subtract from the weight of asphaltic concrete the weight of asphalt cement <br />and mineral additives to arrive at the weight of the gravel. <br />D. During any times that Com does not have a scale located at the Property <br />which can be used to weigh the material removed from the Property, Com shall utilize the <br />procedures set forth in this Paragraph to determine the amount of material removed. As soon <br />as practicable after the removal of the scale from the Property, Corn shall cross-section all <br />stockpiles on the Property, and shall determine the volume of material in each stockpile (in <br />cubic yards). Com shall cross-section the stockpiles and redetermine the amount in the <br />stockpiles at least annually thereafter. Com shall provide Yellow Jacket with copies of its <br />cross-section measurements and volume calculations, and will review such measurements and <br />calculations with Yellow Jacket's representatives upon request. Corn shall also keep accurate <br />records of materials removed from the Property by truck capacity, truck type and truck load <br />count, and detemine on a monthly basis the number of cubic yards of materials removed from <br />the Property. Com shall reconcile these monthly product removal records against its volume <br />calculations when it cross-sections the stockpiles each year, and shall pay Yellow Jacket a <br />royalty on any shortages disclosed by such reconciliation. <br />E. Com shall provide Yellow Jacket with a written statement as to all materials <br />removed by it during the preceding month and shall make payment to Yellow Jacket of any <br />royalty due by the 25th day of each month. <br />F.
