<br />Property, at the rates set forth in Paragraph S.B., below. The cubic yard royalty shall be <br />determined using a conversion factor of 1.5 short tons per cubic yard. No production royalty <br />shall be paid to Yellow Jacket unless and until the product has been removed from the <br />Property. <br />B. The production royalty referred to in Paragraph S.A., above, shall be paid ai <br />the following rates: <br />i. For product removed from the Property between the date of execution <br />of this Lease and December 31, 1999, the production royalty shall be <br />eighty-five cents ($0.85) per short ton, or one dollar and twenty-eight <br />cents ($1.28) per cubic yard. <br />ii. For product removed from the Property between January 1, 2000, and <br />December 31, 2002, the production royalty shall be ninety-five cents <br />($0.95) per short ton, or one dollar and forty-three cents ($1.43) per <br />cubic yard. <br />ii. For product removed from the Property between January 1, 2003, and <br />the end of the Lease term, the production royalty shall be one dollar <br />and five cents ($1.05) per short ton, or one dollar and fifty-eight cents <br />($1.58) per cubic yard. <br />C. Corn anticipates that it will initially have a scale located at the Property. <br />During times when Corn has a scale located at the Property, Corn shall weigh all materials <br />before removal from the Property and Corn shall preserve all material weight tickets.
