• available to the Division. <br />(3) In no case shall the bond for the entire area under one permit <br />be less than $10,000. <br />(4) The amount of the performance bond required shall be adjusted <br />for good cause as affected Land acreages are increased or decreased or <br />when the cost of Euture reclamation changes including the cost of abating <br />any violation for which a notice of violation has been issued. The <br />Division shall review the amount of bond required for a permit area and <br />the terms of acceptance of the bond at the time permit reviews are <br />conducted under 2.08.3 or every two and one-half years, whichever is more <br />frequent. The procedures for any adjustment shall include: <br />(a) The Division shall notify the permittee of any proposed <br />bond adjustment and provide the permittee with an opportunity for an <br />informal conference on the adjustment. <br />(b) A permittee may request reduction of the required <br />performance bond amount upon submission of evidence to the Division <br />proving to the Division that the permittee's method of operation or other <br />circumstances will reduce the maximum estimaed cost to the Division to <br />complete the reclamation responsibilties and therefore, warrant a <br />reduction of the bond amount. Such a request shall be considered as a <br />request for partial bond release under 3.03. <br />(5) The amount of bond, as determined under this Rule and as <br />3.02-2 <br />
