these calculations and CDPHE guidelines and regulations, the Whirlwind Mine requires a <br />construction permit, but does not require modeling. <br />It should be noted that Energy Fuels expects that line power will be supplied to the mine <br />site within 12 months, in which case the generators listed in the attached APEN would no <br />longer be used and would be exempt from the APEN. A schedule for establishing of line <br />power to the mine site has not been finalized at this time and is out of Energy Fuels' <br />control. As such, we have included the generators in our calculations as a stationary <br />source (i.e. present in one location for greater than 12 consecutive months). This <br />conservative approach was used to cover the mine in the event that line power is not <br />established in a timely manner. <br />A check for $359.88 for the three APENs is enclosed.
