Long, <br />Division Director <br />The following items must be addressed by the applicant in order to satisfy the <br />applicable requirements of C.R.S. 34-32-101 et sec. and the Mineral Rules and <br />Reguiations of the Mined Land Reclamation Board. <br />General <br />`/ <br />l. You have provided the Division a copy of a public notice plac ed in the <br /> Canon City Daily Record; however, in accordance with Rule 2.2 .2.(2), you <br /> have not provided proof of publication. Please provide this proof. <br />"J 2. You have provided a list of certified mailings and certified mail <br /> receipts. In accordance with Rule 2. 2.2(6), provide proof of required <br /> notices by providing copies of signed return receipts. <br />Exhibit D - Mine Plan <br />At this time Rocky Mountain Materials and Asphalt, Inc. has no plans to <br />mine the Phase VI area. Neither a mine plan nor reclamation plan for <br />this area was submitted with the application. Provide a revised Mine <br />Plan Map that does not indicate that this area dill be affected by mining <br />activities. Also remove 'reference to the mining of this area from the <br />Mining Plan Narrative. This phase should be added to the permit as an <br />amendment after the permit is issued. <br />An alternative to this would be to provide mining and reclamation plans <br />plus a list of permits applied for regarding the mining of this area. If <br />this alternative is chosen, you will have to notify all applicable <br />parties and a new date would be set for consideration by the Division. <br />2. A power line owned by West Plains Electric is located within land to be <br />affected by mining. The mine plan as stated could adversely affect the <br />stability of the power poles. Provide detailed plans for the method you <br />will use to protect the stability of the poles. Or, provide a copy of an <br />agreement between West Plans Electric and Rocky Mountain Materials and <br />Asphalt, Inc. that states that damage to the power line will be <br />compensated for by the mine operator. <br />
