• • III IIIIIIIIIIIIIIII <br />999 <br />October 23, 1986 <br />COLORADO MINED LAND RECLAMATION BOARD <br />I come before you today to contest the proposed increase in the <br />reclamation bonding on our Phoenix mine (Limited Impact Permit M-82-075). <br />I feel that the reclamation permit is a legal instrument that may be <br />altered under certain circumstances, including but not limited to: <br />- Change in the laws governing the permit, <br />- Change in the mining plan or reclamation plan, <br />- Change in overall economic conditions. <br />The Mined Land Reclamation Division has recommended a bond increase of <br />650 to 900 percent based on "current economic conditions". <br />Figure 1 shows actual inflation rates (CPI) from 1982 to mid-1986 ranging <br />from 3 to 6 percent versus the 50 to 60 percent inflation rate estimated <br />by the MLRD. There is an order of magnitude difference between the rates. <br />Based on actual historic figures, any bond increase due to "current <br />economic conditions" should be limited to a $50 maximum increase. <br />Our mining plan is basically unchanged since the original permitting in <br />April 1982. Our activities since 1982 were: <br />- Drove approximately 262 feet of development drift and did minor <br />stoping, moving approximately 1000 tons of rock, all of which is <br />stored in underground stopes, none of which came to the surface, <br />- Removed old tressel as requested by area residents (14 to 16 families <br />live along Trail Creek road year-round) for better sight along the <br />road, and as recommended by MSHA as an unstable structure, <br />- Leveled by grading the area south and east of the ore bin as requested <br />area residents for better sight around that blind curve, <br />- Regraded the road to the top of the dump as necessary. <br />Disturbed land is summarized as: <br />1. Total land disturbed from 1930s to present (includes only direct <br />mining land and does not include the original discovery shaft, stopes <br />open at the surface, old prospect holes, or proposed future work), <br />Area = 27,000 sgft or 0.6 acres. <br />2. Land disturbed prior to current operations (mainly in the 1930s <br />and 1940s), <br />Area = 23,500 sgft or 0.5 acres. <br />3. Land disturbed to date by current operations and subject to MLRD, <br />Roads/access = 3,000 sgft or 0.07 acres, <br />Other Uses = 500 sgft or 0.01 acres, <br />Total area = 3,500 sgft or 0.08 acres. <br />4. Land proposed for future activities (ore dressing facility and <br />settling pond), <br />Area = 3,200 sgft which includes 500 sgft included under 2 above, <br />or 0.07 acres. <br />
