TETRATECH RMC Mc Larry Oehler <br />Adequacy Response M-2004-044 <br />November 22, 2004 <br />Page 5 of 20 <br />S. Your Mining Plan, on page D-2, states that the West Fill Area will require <br />installing temporary crossings at the Brighton and Brantner Ditches. Please <br />provide construction plans for the crossings. IjAggregate Industries has not <br />already done so, provide copies of the agreements for encroachment into the <br />ditch companies properties orrights-of--way for construction of the crossings. <br />As stated in note number 15 on the Mining Plan Maps (sheet 4 and 5) Aggregate <br />will not disturb the irrigation ditches until an agreement has been reached with the <br />Ditch Companies. The temporary ditch crossings are private access for Aggregate <br />Industries and will be designed and approved by the Ditch Companies prior to <br />installation. The Ditch Companies received the Public Notice of the application <br />by certified mail. Project information, including Mining Plan Map (Sheet 4 of 7) <br />has been submitted to the Brighton and Brantner Ditch Companies. We will <br />continue to work with the Ditch Companies and keep the Division informed of the <br />progress. Upon final review and approval of the crossings, we will forward <br />copies for your file. <br />6. Recently the Mined Land Reclamation Board included on page 6 of the 112c <br />permit application package a "Permit Condition"regarding reportable spills. <br />Your application does not have the permit condition. Please add the following <br />condition of approval to your application. <br />A reportable spill is a spill of any toxic or hazardous substance (including spills <br />of petroleum products) within the mined land permit area reportable to any <br />Division of the Colorado Department of Public Health and the Environment, <br />the National Response Center, the Colorado Emergency Planning Commission, <br />any local Emergency Planning Commission, local Emergency Planning <br />Committee, or the State Oil Inspector. The mine Operator shall notify the <br />Division of Minerals and Geology (DMG) of a reportable sill within the mined <br />[and permit area using the same timeframe required by the permit, license, <br />notice, statute, rule or regulation governing the reporting of the spill to the <br />other appropriate agency. Notice of a reportable spill shall be FAXED to: <br />Minerals Program Supervisor, Division of Minerals and Geology, FAX (303) <br />831-8106. The FAX shall include acall-baek number of a responsible company <br />official for DMG staff to use as a contact. <br />On June 25, 2004, Mike Refer hand-delivered Page 6 of the application form to <br />the Division office, which includes this condition. <br />7.
