Mr. Larry Oehler
TETRA TECH RMC Adequacy Response M-2004-044
November 22, 2004
boundary. Please correct the boundary to show that the 27.2 acres is plmmed to
be included.
The boundary on the attached maps has been revised to include the +/- 27.2 acre
parcel.
2. The Existing Cond&ions Map, Exhibit C Sheet 3 of 7 does not accurately re, fleet
the existing conditions in the 27.2 acre parcel presently part of permit Na. M-
1991-140. Please show the exposed ground water as it presently exists in that
area.
The Existing Conditions Map (Sheet 3 of 7) has been modified to show the mined
area.
3. Rule 6 Section 4.3 (c) requires that Exhibit C Maps show the total area to be
involved in the operation ,including the "Area of Affected Lands." The
definition of "Affected Lands"Rule 1 Section 1.1(3), in part, states "means the
surface of an area within the state where a mining operation is being or will be
conducted, which surface is disturbed as a result of such operation. " Part of
the reclamation of the proposed permit area is the construction of a slurry wall,
which crosses the county road right-of--way for Tucson Street. Please show the
portions of the right-of--way that will be affected by construction of the slurry
wall, as being included in the proposed permit boundary. Make appropriate
changes to all other Exhibits, as necessary. Do the same for areas where pipes
and or conveyors cross road rights-of--way, if the surface of the land will be
affected.
The "affected lands" boundary has been shown on the attached Maps. We
anticipate that all the property could potentially be impacted and have shown the
maximum area of affected land on the plan. In addition we have included the
areas where piping, the conveyor crossing and the slurry wall will be located
within the Street/Highway right-of--way. Please note that page one of the
application should read 291.5 acres. We have revised page one of the application
with the corrected acreage of "affected land". We will work with Adams County
and Colorado Department of Transportation on the construction of the stmctures
within the right-of--way and road crossings. We will forward approvals of these
agencies to the Division upon request.
4. Please add a symbol to the legend for "Affected Land Boundary" and change
the symbol "Property Boundary" to "Permit/Properry Boundary'; if the permit
and property boundaries are always the same. Add to the maps Affected Land
Boundaries to delineate a[I areas that will be affected by the mining operation.
This map symbol should be used to delineate all areas that will be affected that
are within areas that will otherwise remain unaffected, such as, the road and
H93919_019_Ol\M LRB\DMG Response\Is[ Adequacy Response to DMG I I-S-OS.doc
