E. Ponds Of0 and 012 Deoletions.
Seneca Yoast Mine Pond 010 will be constructed on an uttttamed tributary of •
Scotchman's Gulch, which is a tributary of Grassy Creek. Storage of surface
water in Pond 010 will therefore t:atue depletions to Grassy Creek and the
Yampa River.
Seneca Yoast Mine Pond 012 wall be cotuttucted oa an nnn~med tributary of
Sage Creek. Stooge of surface water in Pond 012 will therefore catLSe
depletions to Sage Creek and the Yampa River.
F. Auttmentation of Grassv Creek and Yamna River.
Pond 010 will be an alte:tnate point of storage for the Sage Creek Reservoir water
nigh[ and use of such water will be limited [0 45.5 acre-feet annually for
industrial purposes, evttporazion and maintenance of storage reserves. The use
of the Sage Creek Reservoir storage right will be limited to those times when the
Sage Creek Reservoir right is in priority and wazer is physically and legally
available at its original point of storage: in addition, during the irrigation season
storage will be limited to those quantities of water flowing pazt the Sage Creek
Ditch to the Yampa River. During other limes. water will be stored in Pond 010
under its own water right or its ou[-of-priority storage of wazer will be replaced
b}• storage releases from Applican['s Wadge Pi[ Reservoir or by contract releases
from Stagecoach Reservoir.
The Yoas[ Mine Shop Well will cause depletions to Grassy Creek az the ra[e of
10.27 percent of the annual pumpage az 15 years. If the well produces 41 acre
feet in a given year, the depletions to Grassy Creek will be 4.21 acre fee[. in
order to replace out-of-priority depietiotu [o Grazsy Creek during the irrigation
season. Pond 010 will retain 2.11 acre feet in storage for release to Grazsy
Creek.
Pos[-mining depletions will be limited to recovery from pumping of the Yoazt
Mine Shop Well. and will rapidly drop to less than 5~I of the average annual
pumpaee. Should the Division Engineer determine Iha[ junior water righu are
being adversely affected by these post-mining depletions, releazes may be
determined by Applicant's ground wazer depletion model, and releases called for
from Stagecoach Reservoir. Recovery will be virtually complete 20 years after
mining is compltted.
G. Auementation of Saee Creek.
Pond O1Z will supply water to the mine for non-potable uses. ]t will be used az
an alternate poinu of storage for the Sage Creek Reservoir wazer nigh[ and. an
alternate point of diversion for the Bates Ditch wazer righ[. Stooge under the
Sage Creek Reservoir wazer right will be limited to 45.5 acre feet annually for
industrial purposes, evaporazion and maintenance of storage reserves. The use
of the Sage Creek Reservoir storage right will be limited to those times whrn the
Sage Creek Reservoir right is in priority and wazer is physically and legally
available az iu original point of storage; in addition, during the irrigazion season
OF FACE AND DECREE
95 Cw 071 8
~~
LJ
16-4-20
