Certification Procedures <br />If the general permit is applicable to the applicant's operation, then a certification will be developed and the applicant will be <br />certified under this general permit. <br />a. Request for Additional Information: The Division shall have up to thirty days after receipt of the above information to <br />request additiona(data and/or deny the authorization for any particular discharge. Upon receipt ofadditional information, <br />the Division shall have an additional thirty days to issue or deny authorization for the particular discharge. (Notification of <br />denial shall be by letter, incases where coverage under an alternate general permit or an individual permit is required, instead <br />of coverage under this general permit.) <br />b. Automatic Coverage: If the applicant does not receive a request for additional information or a notification ofdenial from <br />[he Division dated within thirty days of the receipt of the application by the Division, authorization to discharge in <br />accordance with the wnditions of this permit shall be deemed granted. <br />c. Individual Permit Required: If, after evaluation of the application (or additional information, such as the S W MP), it is found <br />that this genera] perrrtit is not applicable to the operation, then the application will be processed as one for an individual <br />permit. The applicant will be notified of the Division's decision to deny certification under this general permit. For an <br />individual permit, additional information may be requested, and t 80 days will be required to process the application and <br />issue the permit. Temporary coverage under this general permit may be allowed until the individual permit goes into effect. <br />d. General vs. Individual Permit Coverage: Any owner or operator authorized by this permit may request to be excluded Cram <br />the covemge of this permit by applying for an individual CDPS permit. The owner or operator shall submit an individual <br />application to the Division, with reasons supporting the request. <br />6. Permit Certifications. Applicable Sermons: <br />The individual certification prepazed for each applicant will indicate whether Part I.B ofthe permit which must be followed by that <br />applicant. Part I.C must be followed by all permittees unless exempted as outlined in Section 1II.C ofthe Rationale. (In the absence <br />of such indication from the Division, the permittte will be responsible for determining and then complying with the applicable <br />sections in Part I.) In addition, all perrrtittees will be required to comply with Part 1, subparts A, D, E and F, and all of Part II of the <br />permit. <br />7. Permit Expiration Date <br />Authorization ro discharge under this general permit shall commence on Ocrober 1, 2002, and shall expire on September 30, 2007. <br />The Division must evaluate and reissue this general permit once every five years, and must recertify the applicant's authority to <br />discharge under the general permit at such time. Therefore, any permittee desiring corttmnued coverage under the general permit <br />must reapply by March 31, 2007. If the permittee's individual certification does not indicate that Part l.B of the pertnmt must be <br />followed (i.e., the certification is for stotmwater discharges only), the permittee must reapply by June 30, 2007 if they desire <br />continued coverage underthe general permit The Division will initiate the renewal process; however, it is ultimatelythe pertnittee's <br />responsibility to ensurethaitherenewalissubmmtted. TheDmvisionwilldetermineiftheapplicammaycontinuetooperateunderthe <br />tents ofthe genera! permit. An individual permit will be required forany facility not reauthorized to discharge under the reissued <br />general permit. For facilities wishing to terminate authorization under the new permit, provisions of Part II.B.S.d will be applicable. <br />8. Inactivation ofCertification <br />The permittee may request inactivation of their certification under this permit, once the site has been fully released from their <br />reclamation bond requirements by the Colorado Division of Minerals and Geology (CDMG). See Pan II.B.S.d of the permit. <br />
