Third Adequacy Review Letter. <br />7. MMC will make sure the pond embankment construction meets <br />the 3:1 ratio and the four ponds to be stabilized with vege- <br />tation at end of mining. ' <br />8. MMC will save all the topsoil when expanding the four <br />settling ponds and as indicated use other on site materials <br />to shape the embankments. <br />Exhibit D - Reclamation Plan (Rule 6.3.4) <br />9. MMC will follow the NRCS Reclamation Plan. <br />10. MMC has committed to replace topsoil as evenly as possible <br />over all the areas required in the Reclamation Plan. <br />11. MMC estimates the topsoil to be removed would average less <br />than six inches. Again, over the required Reclamation Areas, <br />whatever topsoil removed will be spread as evenly as possible <br />at the time of Reclamation. <br />12. MMC recognizes the importance of drainage and erosion control. <br />MMC will monitor both during the life of the mining operation <br />and keep culverts and roads in good condition. <br />13. MMC acknowledges closing the portal by back fill with a drain <br />pipe on the floor. <br />14. MMC will work with BLM to expedite the written permit required <br />on the 2.09 acres of BLM land and that MMC is not permitted <br />to conduct any mining related activity until the permit is in <br />your hands. This permit is separate from the BLM access road <br />permit. The BLM access road permit expires December 31, 2028. <br />In checking with Ophir-Nevada Inc. the next rental payment <br />on the access road is due December 31, 2003. MMC will monitor <br />this requirement and make sure the payment is timely. MMC <br />plans to complete the road improvements prior to December 31, <br />2003. No bonding is required only timely rental payments <br />calculated every five years. <br />15.
