Any violation or' any state regulation <br />or statutes relating to this operation shall be grounds for <br />immediate termination of this permit. <br />8. Rehabilitation of Site: Clayton and Son Construc- <br /> <br />tion Co. has represented to the Board of County Commissioners that <br />the excavations created by this operation will be rehabilitated <br />and reclaimed pursuant to the reckuirements oc the Colorado Open <br />Mining Land Reclamation Act of 1973. Specifically, permitee has <br />represented that in its application to tha State of Colorado nor <br />a permit to conduct this gravel extraction operation it will enter <br />into a land stabilization and reclamation agreement in the form <br />set forth in the attached Exhibit "A", which by this reference is <br />incorporated herein and made a part hereof. permitee, k>y signing <br />this agreement, does hereby make the same representations and com- <br />mitments to the Board of County Commissioners of Grand County <br />regarding the stabilization and reclamation of this site. <br />l <br />" 9. Bond: In order to insure the performance' of the <br />reclamation and stabilization plan proposed by the permitee, as <br />set forth in the attached Exhibit "A", permitee shall furnish to the <br />Board of County Commissioners of Grand County a performance bond <br />in the amount of Fifteen Thousand Dollars ($15,000.00) to insure <br />that the work required by said agreement will be accomplished. <br />10. Limitation of Liability: The Board of (:ounty Com- <br />missioners by the issuance of this permit assumes no responsibility <br />for the operation of the site and the Clayton and Son Construction <br />Co. hereby covenants and agrees to hold Grand County harmless for <br />any injury or damage which may occur, of :;hatever type or nature, <br />as the result of the operation contemplated by this permit. Clayton <br />and Son Construction Co. warrants that it will obtain appropriate <br />liability and hazard insurance to compensate any individuals who <br />may be injured or damaged in any manner by the conduct of this <br />business. permitee further warrants and agrees to compensate Grand <br />County for any expense incurred in the defense of any lawsuit or <br />-5- ~.,,.r,.r.J~•. <br />
