` _ ,~ --~ <br />-2- <br />As an afternatfve to the 10-foot storage restriction during this <br />irrigation season, you may choose to begin ,a monitoring program that would <br />be supervised by your engineer. You would then be able to store water to <br />a level 7 feet below the crest of the dam for a one month period only. For <br />a 3 month period, the embankment and seepage will be monitored and the <br />corresponding water level noted by your personnel 3 times per week. A report <br />should be submitted monthly to this office by your engineer. <br />If you have not already done so, you should establish a written plan <br />for dealing with any emergency situations that might arise due to a partial or <br />total failure of dam structures that you own. The plan should include actions <br />to be taken in case of impending or partial failure of the dam (i. e. , slides, <br />excessive seepage, overtopping by flood waters, etc.) and actions to contain <br />outflows should a breach occur. Items that might be required include engineer- <br />ing supervision, equipment, equipment operators and hand laborers, sandbags, <br />ripmp and fill material, transportation for equipment and materials, and lighting <br />for night work. Your local emergency preparedness coordinator can assist you <br />in locating the nearest sources available. The coordinator for your area can be <br />identified by contacting the Operations Section of Colorado's Disaster Emergency <br />Services Agency at (303) 279-251I Ext. 240 or 241. <br />Procedures to warn and evacuate downstream residents should be <br />coordinated with locel law enforcement authorities. Atter your emergency <br />plan has been drafted, it should be thoroughly reviewed by all persons that <br />will be expected to assist in its implementation including local law enforce- <br />ment, and civil defense personnel. We will appreciate a copy of your plan for <br />our review and file. <br />As a dam owner, you should be aware of Colorado Revised Statutes <br />1973, 37-87-104, which states, <br />"Liability of owners for damage -The owners of the reservoirs <br />shall be liable for all damages arising from leakage or over- <br />flow of the waters therefrom or by floods caused by breaking <br />of the embankments of such reservoirs. " <br />Please inform us of the course of action that you have selected by <br />May 30, 1980, and submit a schedule for completion of the requested work to <br />this office by July 1, 1980. <br />HDS/JTS:mvf <br />Enclosure <br />cc.
