• (D) The chemical analyses of the stratum immediately <br />above and below the coal seam to be mined, or any other stratum to be <br />affected, to identify at a minimum, those horizons which contain acid- <br />forming, toxic-forming, or alkalinity-producing materials; <br />(v) The near surface geology of those surface operations <br />and facilities not underlain by the coal seam to be extracted shall be <br />described, including the following data resulting from analyses of test <br />borings, core Samplings or outcrop samples: <br />L ) A description of near-surface strata beneath the <br />disturbed area; <br />(B) The litho logic characteristics of the strata to be <br />affected, including physical and chemical properties identifying, at a <br />minimum, texture; and analyses to identify those horizons which contain <br />potential acid-forming, toxic-forming or alkalinity-producing materials. <br />• (b) An applicant may request that any requirements of <br />2.04.6(2)(a)(iii) be waived by the Division. The waiver may be granted <br />only if the Division makes a written determination that the statement <br />required is unnecessary because other equivalent information is available <br />to it in a satisfactory form. <br />RESPONSE: <br />Geologic Setting and Structure <br />The fish Creek Tipple Area is located in the southeastern corner of <br />the Washakie-Sand Wash Structural Basin, as shown in Figure 1, <br />Geologic Structural Setting. This structural basin extends from <br />northwestern Colorado to south-central Wyoming with the main axis of <br />the basin being highly modified by numerous smaller anticlines, <br />synclines and faults. <br />Structurally, the proposed permit area is situated along the east <br />flank of the locally significant Twentymile Park Syncline.
