<br />7. The Division is concerned regarding the potential for the lateral berm that will support the <br />Sinclair pipeline following mining to be washed out during a flood. Please provide a design for <br />the Division's review that will demonstrate and ensure equalization of hydrostatic pressure <br />between the two mining ponds during a flood. This design must be approved prior to a Division <br />recommendation of approval of [he application. (Attached are review comments from Allen <br />Sorenson of the Division). Please address. <br />Once again, I will look forward to your response on or before February 9, 2001 to allow adequate <br />time for review before the February 19, 2001 decision date. Rule 1.8.1 states that changes and <br />additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder.
