Mr. Chris Rowe <br />December 15, 2006 <br />Page Two of Two <br />In order to meet the requirements of Rule 63.12(a), to date, the Applicant has made <br />numerous attempts to contact the appropriate individuals associated with the above <br />structures and is currently working with a representative of the Godding Ditch. <br />Unfortunately, time constraints make it difficult to execute any kind of an agreement <br />regarding menntade structures in a timely manner. <br />The Applicant recognizes that the Division cannot release the pemtit and <br />reclamation bond until the Applicant can demonstrate that the completed reclamation <br />meets the requirements of the SEO. <br />The Applicant would like to add Developed Water Storage as a post -reclamation <br />land use for the Camenish Borrow site. <br />Personal communications on Thursday, December 14, 2006 with the owner of <br />Idaho Creek Resources and with a representative of L.G. Everest - Rinn Valley <br />Resources confirmed that both pits will be sealed as part of the reclamation process <br />following mining. Indeed, a significant portion of the Idaho Creek Resources Pit has <br />already been sealed by the operator. Therefore, sealing the Camenish Borrow pit will <br />have no negative hydrologic impact on Idaho Creek and Rinn Valley Resources pits. <br />Please do not hesitate to call me if you have any questions regarding this letter. <br />Also, please advise if the Division requires an additional time extension regarding this <br />pemut application. <br />Sincerely, <br />Michael J.
