<br />' Page 50 <br /> Construction Materials Rule 3 <br />' (b) compliance with applicable federal and Colorado <br /> water quality laws and regulations, including statewide water quality <br /> standards and site-specific classifications and standazds adopted by <br /> the Water Quality Control Commission; <br /> (c) compliance with applicable federal and Colorado <br />' dredge and fill requirements; and <br /> (d) removing temporary or large siltation stnrctures from <br />' drainways after disturbed azeas are revegetated and stabilized, if <br /> required by the Reclamation Plan. <br /> tre(4)(~) (2) Earth dams, if necessary to impound water, may be <br /> constructed if the formation of such impoundments will not damage <br /> adjoining property or conflict with water pollution laws, rules or regulations <br /> of the federal government, the state of Colorado or with any local <br />' government pollution ordinances. <br /> (3) All surface areas of the affected land, including spoil piles, <br /> shall be stabilized and protected so as to effectively control erosion. <br /> 3.1.7 Groundwater -Specific Requirements <br /> (1) Standards and conditions applicable to classified and <br />' unclassified groundwater. <br /> (a) State-wide groundwater quality standards: Operations <br /> that may affect groundwater quality shall comply with all state-wide <br /> groundwater quality standards established by the Water Quality <br /> Control Commission (hereafter, the WQCC). <br />' (b) Classified areas: Operations that may affect the <br /> quality of groundwater in a specified area that has been classified by <br /> the WQCC shall comply. with the standards applicable to such <br />' specified area. <br /> (c) Unclassified areas: Operations that may affect the <br />' quality of groundwater which has not been classified by the WQCC <br /> shall protect the existing and reasonably potential future uses of such <br /> groundwater. <br />' (d) Water quality standards applicable to groundwater that <br /> has been classified, state-wide standards for certain pollutants, and <br /> interim narrative standazds set by the WQCC shall supersede any <br />' numeric protection levels established for the subject pollutants <br /> pursuant to this Subsection 3.1;7. <br /> <br /> <br />1 <br />
