A. <br />Ingress/Egress Access <br />and <br />Property Damage Compensation Agreement <br />This Agreement made this /~~ day of ~°"`1' 1993, by and between <br />Richard H.. Grant and David J. Winograsky, dba Delta Electric, of 26675 U.S. <br />Highway 40, Steamboat Springs, Colorado, herein referred to as the Owner, and <br />Duckels Construction, Inc. dba Yampa Aggregates, a corporation organized under <br />the laws.of the State of Colorado, located at 41230 RCR #129, Steamboat Springs, <br />Colorado, herein referred to as the Operator. <br />This agreement provides non-exclusive right as owners rights may exist for <br />Operator t.o use existing roads from the property access to U.S. Highway 40 and <br />access.-to~~and use of the scales located on the Owner's property in exchange for <br />a scale fee to be paid by the Operator. The property is particularly described <br />in. _Exh=ibit "A" attached hereto and made a part hereof this agreement. This <br />agreement is subject to the following conditions. - .-._ <br />SECTION ONE <br />LEGAL RIGHT TO ENTER <br />_- Richard H. Grant and David J. Winograsky, owners. of the. property described <br />_=in Exhibit "A",.grant_Duckels Construction, Inc. and ..its Subcontractors certain <br />Legal Right of Owner to Enter the property described in Exhibit "A". This right <br />is granted for access to the scales owned by Grant and Winograsky. This access <br />will not be used for the primary access to the Hogue/River Pit. The access to <br />the rear of the property has been approved by Routt County. The fence and gate <br />at the rear access to the Grant and Winograsky property will be maintained by <br />Duckels Construction, Inc. It is not anticipated that this right will have any <br />affect on the status of the current access. It is furthermore not anticipated <br />that any modifications will be necessary to the existing access. <br />The ::c ale access road will be delineated by the Owner. The Operator will <br />limit operations to within the delineated boundaries. The scale access road will <br />be maintained by the Operator. Upon the Owner's approval, the Operator may <br />upgrade ttie scale access road. Improvements to the access road will be subject <br />to the approval of the Owner. <br />SECTION TWO <br />TERMS OF AGREEMENT <br />This Ingress/Egress Access Agreement shall remain in effect for a period of <br />ten years from the 1st day of April, 1993 to the 1st day of April, 2003, unless <br />cancelled. At that time this agreement shall be expired unless extended or <br />renewed b}~ written mutual agreement between the Owner and the Operator. <br />
