Section 816.116 Continued. <br />(c1 The person who conducts surface mining activities shall: <br />(1) Maintain any necessary fences and proper management practices; and <br />(21 Conduct periodic measurements of vegetation, soils, and water prescribed or <br />approved by the regulatory authority, to identify conditions during the <br />applicable period of liability specified in Paragraph (b) of the Section. <br />Fences will be constructed and maintained to exclude livestock and prevent <br />grazing until the level of vegetative establishment is adequate to withstanding <br />grazing pressure. Once limited grazing is initiated, management practices will <br />focus on effective reestablishment of aself-sustaining vegetative community <br />and achievement of revegetation success objectives. <br />During the period of liability, studies will be conducted at least 2 years, at <br />approximately 5 to 6 years, and at least 9 years following completion of <br />permanent seeding to evaluate vegetation conditions and trends on reclaimed <br />areas. The vegetation conditions will be evaluated utilizing the study <br />procedures described in Sections 779.19(bl. Soil conditions will be <br />monitored at least every third year to determine current erosion features <br />(USDA, Bureau of Land Management, Manual 7322 - Watershed <br />Conservation and Development System, March 20, 1972) such as rills, flow <br />patterns, gullies, soil movement and deposition, pedestalling, and presence of <br />surface litter. Surface water quality will be analyzed for the parameters listed <br />in Table 61, Kerr Hydrologic Monitoring Schedule. <br />If the 1999 revegetation monitoring data indicates that revegetation success <br />standards have been met for areas seeded to 1995, data from the two most <br />recent monitoring efforts will be used to document revegetation success and <br />support a Phase 3 bond release application for these areas. Otherwise these <br />areas, as well as the areas seeded in 1995 and 1996, will be sampled again <br />in 2001. The areas seeded in 1995 and 1996 will be sampled at least one <br />more time in 2006 prior to final bond release. <br />TR-19 816-161 Revised •August 1999 <br />
